In a major judicial outcome bringing closure to a decade-long legal battle, the Goa bench of the Bombay High Court on Thursday, August 6, 2026, sentenced former Tehelka editor-in-chief Tarun Tejpal to 10 years of rigorous imprisonment. The sentencing follows the High Court’s decisive verdict overturning his May 2021 acquittal by a Goa sessions court, finding him guilty of sexually assaulting a junior female colleague inside a hotel elevator in November 2013.
Delivered by a division bench comprising Justice Dr. Neela Gokhale and Justice Amit Jamsandekar, the court applied the mandatory minimum statutory penalty prescribed under Indian Penal Code (IPC) Section 376(2) for sexual assault committed by a person in a position of trust and authority.
Rejection of Leniency Arguments and “Position of Trust”
During arguments on the quantum of sentence, Tejpal personally addressed the bench to appeal for judicial leniency, pointing to his age and family responsibilities. “I am 62, and I believe I am a victim. I have a wife… Please be lenient with me,” Tejpal pleaded before the judges. His defense counsel, Senior Advocate Aabad Ponda, also highlighted that over 13 years had elapsed since the alleged event without any other criminal records or FIRs registered against him.
However, the prosecution, led by Solicitor General Tushar Mehta representing the State of Goa, strongly opposed any mitigation. SG Mehta urged the court to deliver a uncompromising message regarding workplace safety and power dynamics.
“Despite the victim being a girl of his daughter’s age, he committed an offence. He was a father figure and should not have indulged in this. A precedent must be set… This court must give out a clear message to society that when a girl says no, it means no. A No Means A No,” the Solicitor General submitted.
Accepting the state’s arguments, the High Court held that the breach of professional trust and authority rendered the act severe, warranting full application of the 10-year statutory sentence.
“I Can Be Acquitted 10 Times”: Tejpal Vows Supreme Court Appeal
Speaking to reporters outside the courtroom following the sentencing, a defiant Tejpal maintained his innocence and rejected the High Court’s findings, claiming political targeting and asserting that crucial evidence had been overlooked.
“This is a wrong case against me. We will fight back and I have faith in the judiciary,” Tejpal declared to the press. “There is so much evidence that I can be acquitted 10 times.”
Tejpal’s legal team immediately began preparing an urgent petition before the Supreme Court of India seeking a stay on the conviction and suspension of the 10-year sentence.
A Decade of Litigation: Background of the Case
The case stems from November 2013 during Tehelka’s annual ‘THiNK’ festival at a luxury hotel in Bambolim, Goa. A junior journalist accused Tejpal of subjecting her to sexual assault inside a resort elevator. Following her internal complaint to then-managing editor Shoma Chaudhry, Tejpal sent an email acknowledging a “shameful lapse of judgment.”
Goa Police subsequently took suo motu cognizance of the matter on November 22, 2013, arresting Tejpal later that month. After spending seven months in jail, he was granted bail by the Supreme Court in July 2014. While the Mapusa Sessions Court acquitted him in May 2021 on grounds of benefit of doubt, the State of Goa successfully challenged the ruling before the High Court, leading to the reversal and 10-year sentence.
