Thiruvananthapuram: In a significant move ahead of the upcoming General Elections to Local Self Government Institutions, the Kerala State Election Commission (SEC) has imposed a complete ban on the transfer of officers and staff across various government departments and institutions. The order (Order No.B2/101/2025-SEC), issued on October 3, 2025, invokes powers under Articles 243 K and 243 ZA of the Constitution of India and directs the immediate restriction of all such transfers.
Key Directives and Institutions Covered:
The transfer restriction is effective from October 3, 2025, and will remain in force until the completion of the entire election process. The ban applies to staff and officers under the control of the Chief Secretary and the Heads of all:
- Government Departments
- Local Self Government Institutions (LSGIs)
- Educational Institutions (including Government and Aided)
- Public Sector Undertakings, Statutory Boards, Corporations, and Universities
- Other authorities as specified in the Kerala Panchayat Raj Act, 1994 (Sections 132 and 145) and the Kerala Municipality Act, 1994 (Sections 156 and 202).
Reasoning for the Ban:
The Commission is currently making “expeditious and time-bound preparations” for the conduct of elections, which includes preparing the list of officers and staff to be drafted for election duties. The collection of staff details is currently in progress using the e-drop software system, primarily involving employees of all Government and Aided Educational Institutions for deployment as presiding and polling officials.The Commission noted that the transfer or dislocation of any such officer at this stage would “disturb the whole election process” and is “bound to create serious dislocation and confusion and hence is likely to lead to grave disturbance in the election preparedness”. The order also notes previous instances of frequent transfers, which were frozen by the Commission.
Exemptions and Prior Clearance
The State Election Commission has clarified that in cases where the transfer of an officer is “inevitable on account of administrative exigency,” the concerned Government or Head of the Office/Department must approach the State Election Commission or the District Election Officer for prior clearance with full justification.The order highlights that these directions are issued in furtherance of a free and fair election. The Commission has also appointed Returning Officers from various departments for all levels of Panchayats and Municipal bodies.
