Kerala Govt Moves to Overhaul Organ Donation Norms Amid Multi-Lakh Illegal Trafficking Probe

K-SOTO Drafts Stringent Measures to Curb Exploitation

Following alarming revelations of large-scale commercial organ trafficking operating under the guise of medical tourism, the Kerala state government is preparing to enforce rigorous new regulations for organ transplants. The state’s nodal agency for organ transplantation, the Kerala State Organ and Tissue Transplant Organization (K-SOTO), has formulated a comprehensive draft to replace existing provisions established back in 2010.

The regulatory overhaul comes in the wake of joint investigations by local police and the Enforcement Directorate (ED). In June, ED officials raided nine prominent locations across the state—including major private multi-specialty hospitals—after registering cases under the Prevention of Money Laundering Act (PMLA) based on multiple Kerala Police FIRs. Investigators uncovered that syndicates recruited financially vulnerable donors through middlemen, offering them between ₹5 lakh and ₹15 lakh while charging desperate recipients upwards of ₹20 lakh to ₹35 lakh or more.

Mandatory Police “Altruism Certificates” and Verification

To safeguard economically disadvantaged populations and women from exploitation, K-SOTO’s draft guidelines introduce a multi-tiered verification procedure. Donors will now be required to obtain a formal “altruism certificate” from law enforcement agencies following a thorough investigation into their background, employment status, financial standing, and genuine connection with the recipient.

Crucially, the draft ends the reliance on informal verification channels. Self-attested documents and recommendation letters from Members of Parliament (MPs) or Members of the Legislative Assembly (MLAs) will no longer be recognized as valid proof of donor-recipient relationships. Only official government-issued documentation establishing direct relationships will be accepted.

Deep Financial Scrutiny and Consent Safeguards

Under the proposed Standard Operating Procedures (SOP) for non-related organ transplants, authorities must thoroughly examine financial disparities between donors and recipients to eliminate commercial motives. Both parties must produce evidence of their residence, occupation, and bank account statements covering the preceding three years.

For female donors opting to donate an organ to a non-spouse recipient, the rules require written consent from close relatives, including parents, children, or husbands. Female donors must also submit bank records for both themselves and their spouses for the preceding year.

Enhanced Legal and Healthcare Guarantees

To prevent coercion, the draft mandates video recordings of all consent statements made by donors and attending witnesses. Furthermore, donors will undergo a compulsory psychological evaluation to evaluate their mental health and ensure their consent is informed and entirely voluntary.

To protect donors’ long-term well-being post-surgery, hospitals will be required to provide mandatory healthcare insurance coverage. K-SOTO expects to finalize and enact these revised guidelines following imminent stakeholder consultations with private and public healthcare institutions across the state.
